Greenwood challenges Bargersville on two fronts

by: Dann Veldkamp Monday, November 30th, 2009

The Greenwood Common Council voted to continue one and start a second lawsuit with Bargersville in a short special meeting late this afternoon.

In the first action the council voted six-to-one, with Councilman Ron Bates the only “no” vote, to appeal the summary judgement assessed against it earlier this month in a dispute over land along SR135.

In the second action the council voted unanimously to seek a declaratory judgement concerning the  doctrine of first in time over what have become known as the south-east and south-west annexations by Bargersville. The council seeks to determine if the formation of a reorganization committee takes precedence over the annexation actions of Bargersville.

Each of these decisions if further discussed in its own story.
